土地買賣糾紛問題 - 詐欺罪

本人購買農650坪地臨大排水溝,仲介和地主並未告知,鑑界後竟發現有30坪左右在大排水溝中,已付了訂金87萬,本人想解除契約,但要如何解除?契約書上有註明1.坪數以鑑界為準。2.現況點交,以產權說明說為準。現在賣方不肯解除契約,說以現況點交為準,否認有不實。請問這可以構成詐欺罪嗎?
