我父親有北市一棟透天的 2,3,4樓
一樓是早期祖父賣給外人以下簡稱甲
結構類似這樣

父親土地持分3/4
外人土地持分四分之一
但是
房屋並非共有
而是有自己的權狀
現在我父親想說利用土地法34條之一
處分掉土地
但是甲的建物仍然存在
甲他沒有錢用優先購買權買下來
我們也不會故意賤賣
因為是要賣給外人
回母校問教授說
這樣會有民法425-1的問題
他的合法建物還會存在
但是我爬後發現
這個判決

所以順序會是這樣
先賣整塊土地給建商
然後建商拆屋拆掉2,3,4f
我家那種70年房子
拆掉2到4樓
一定會使1f
建物不堪使用的
這時建商是不是就可以開發了
以上是教授還有建商那邊的說法
請問可行嗎?
當然如果他願意參與開發
我們也不會硬吃掉他的土地
