對持分土地方面不太熟悉,所以上來詢問一下意見
小弟奶奶的祖厝居住約有七八十年了
地主以前很受奶奶的照顧
所以才讓我們蓋房子在上面住
但是我奶奶和此位地主都已不在了
土地的繼承權也轉移給土地的幾位兒子
其實地主幾位兒子都想把我們趕走
想把土地收回去自用
但也念在上一輩的交情且我們也住了那麼久
所以偶爾會為了此事做協調
剛好前陣子其中一位地主的兒子
因欠銀行債務被強制拍賣他那1/8土地
其他人也各佔了1/8的土地
我們在想要不要買下這80萬的1/8地
才比較不會被趕走
問題一:想問大家會建議我們買下這1/8嗎??(10/13是第二次拍賣)
問題二:買下後,其餘持分土地的所有人如果要把土地賣了
是不是不需經過我們同意呢??
問題三:承問題二,如果不需經過我們同意賣了土地之後
是不是需要再補償我們地上建物的費用,還有那8/1地的錢??
(家父怕說花了這80萬,結果也是白花還拿不回來)
