問題1：
想請問如果駕駛違規肇事，後座是否須付連帶責任？

新聞說後座須付選擇責任
這讓我想到民法74 年台上字第 1170 號
駕駛機車有過失致坐於後座之人被他人駕駛之車撞死者，後座之人係因藉 駕駛人載送而擴大其活動範圍，駕駛人為之駕駛機車，應認係後座之人之 使用人，原審類推適用民法第二百二十四條規定依同法第二百十七條第一 項規定，減輕被上訴人之賠償金額，並無不合。
所以後座民事的部分還是得負責？？
那如果是對方駕駛受傷，後座同列被告的狀況，也需要負連帶責任嗎？看起來也是要啊？
刑法的部分需要嗎？
問題2
如果乘客主動要求計程車司機違規駕駛
結果司機撞傷對向來車之車主
不過後座在刑法上可以主張司機應該對自己負
責任所以乘客無責嗎？
