請問土地租金的問題 - 法律

背景:
老家是30幾年前家人買下的,當初只買了房子並沒有地下權,土地是一個親戚的(他是當
地整社區的大地主)
從以前到現在,都是由家人幫他繳地價稅(每年1100)和三節繳個1000之類的當作收租(
或是有些鄰居談好是給米之類的)
但是最近那親戚過世了,兒子之一繼承我家那地,現在要求重新收租金。(要求每個月50
00)
所以想問一下收土地租金的標準是否有什麼可以參考?
土地資料:
約53平方公尺
公告市值約8500元/平方公尺
公告土地地價約2000元/平方公尺
一年地價稅約1100
查到土地法97條,是公告地價乘上土地面積的10%是收租金上限(所以每個月應該是最高
不到1000?),但是又有人說民間交易是不受限制的?但是多少錢還是需要雙方磋商協議
對方現在是堅持算法是用公告市值下去算,再加上我們家是三角窗和有4樓什麼的要在加
租金所以才到5000...
因為覺得假設一年6萬,8年左右就能買下地這個比例好像不是很合理,特此一問...
