各位版大好,小弟在去年12月初加入一間外商公司,這幾天收到消息
本人於今年農曆年前最後一個上班天被資遣(等於才上班6週而已) ...
打聽過其他同事消息,該公司近期的裁員率很高(一年約25~30%),也很常發生把人找進
來沒多久後又把人裁掉,雖然聽說都會給資遣費跟非自願離職證明..
但實在心有不甘,因為在進入該公司前,我有其他的正職工作,也有拿到其他不錯的
offer的,後來評估覺得該公司不錯,才決定推掉其他offer到該公司上班,想不到才
加入沒多久就被裁員...
目前打聽到的消息是之前被資遣的人(也是待很短時間) 資遣費約 N+1 (等於兩個月)
請問公司這樣做是合法的嗎?
我有查勞基法第11條的五項資遣事由:
一、歇業或轉讓時。
二、虧損或業務緊縮時。
三、不可抗力暫停工作在一個月以上時。
四、業務性質變更,有減少勞工之必要,又無適當工作可供安置時。
五、勞工對於所擔任之工作確不能勝任時。
公司有可能哪幾項是符合的嗎?
1 => 公司還在
2 => 請公司提出虧損證明之類的? (但也很矛盾,找我進來又馬上裁掉)
3 => 無
4 => 才正接手一個新案子正要開始跑而已
5 => 本人進入該公司前也有多年從事相關領域工作的,更何況案子才正要開始跑而已..
雖然還沒有收到正式的資遣通知,但本人已經收到其他人的消息,本人將於農曆年前的
最後一個工作天被HR約談直接進行資遣流程...
