「預售屋買賣定型化契約應記載及不得記載事項」
中各項視為消費者保護底線的條款是否可經由磋商
條款下修調整?
此舉是否違法並成為無效磋商條款?
定型化契約條款係由一方所擬訂,故常考慮一方利
益,而罔顧消費者利益,甚至有要求消費者棄權等
情事。
譬如,其中交屋款於「預售屋買賣定型化契約應
記載及不得記載事項」中記載為:買方並有權於
自備款部分保留房地總價百分之五作為交屋保留款
,於完成修繕並經雙方複驗合格後支付。
若經雙方磋商交屋款調整為總價1%甚至為零。
是否
仍可於簽約後主張該磋商條款無效並違法,應以
「預售屋買賣定型化契約應記載及不得記載事項」
中的5%為最低限度重新磋商修正?
白話一點,亦即「預售屋買賣定型化契約應記載
及不得記載事項」是否限制著建商預售屋契約內
所有條款,無論是否有經磋商,皆不得劣於「預售屋
買賣定型化契約應記載及不得記載事項」中的相
對應各條款?

函釋即指出此舉為架空法規命令之違法行為。
無奈,函釋仍位建商開條後路,即「建商是否利用
消費者不知」。
所謂「不知」的認定為何?
且若真的已知,說難聽點「事後越想越不對勁」是否
仍可主張「磋商條款」抵觸法規命令「應記載事項」
無效且違法?
