上傳檔案侵權, 主機出租人的法律問題? - 法律

各位先進好, 日前發生了一件頗令人頭痛的事, 百思不得其解下,

終於還是來版上叨擾, 懇請解惑.

關係簡圖:

主機商Dreamhost ======> 我 ========> 侵權行為人W
出租予 復出租予

被侵權人<=不知道要擺哪

事實上侵權行為人是哪一個我也不知道...



我向美國主機商Dreamhost承租一虛擬主機做伺服器之用,

並將其分租予數人, 然日前有一名承租人(以下稱W)因放置影音檔案而遭檢舉,
(Berne Convention)

並由主機商Dreamhost來信告知其承租人, 也就是我. 想請教各位:


1. 版權人之損害賠償請求權是直接及於主機商Dreamhost,或是侵權行為人W? (還是我?囧)

2. 轉租人我是否可適用「網路服務免責規定」(ISP safe harbor)?



3. 檔案放置於國外主機, 是否只有增加搜查難度的效果?

(即是說, 理論上無法以此規避法律. 一直以來我都是這麼認為的.

但是一直有人跟我說因主機在國外故國內警察單位無權管轄.)



以上三問, 懇請各位先進儘可能詳答, 或推薦類似案件判例.

Those all appear to be ripped copies of anime that is copyrighted in
Japan. As Japan and the US are both signatories of the Berne Convention,
all copyright laws still pertain the legal distribution of this material.
If you do have the authority to distribute this content by it's copyright
holders, please get back to us with proof of that and we can re-enable
the sub-domain .
