公司幫員工投保勞保問題 - 法律

朋友兒子最近找了新工作，公司加上老闆約有5,6人。公司有勞保，但只有老闆和老闆娘投保。其餘員工都未投保。
同事回答說，為了節稅，老闆和老闆娘各設立一家公司擔任負責人。所以公司員工名義上可以分成二家公司的員工。所以就達到五人以下不需投保的條件。勞保就請他們自己想辦法。
請問這說法成立嗎？
