專利法第7條第1項所規定,雇用人應支付受雇人適當之報酬,並非係雇用人取得受雇人職
務上所完成之發明依契約所應為之對待給付,非屬因契約互負債務,被告自不得就原告應
給付之適當報酬與移轉系爭專利之義務,主張同時履行抗辯。
個人去查了專利法第7條第1項,其規定為:
受雇人於職務上所完成之發明、新型或設計,其專利申請權及專利權屬於
雇用人,雇用人應支付受雇人適當之報酬。但契約另有約定者,從其約定
問題來了
想問的是
既然專利法已經規定雇用人應支付受雇人適當之報酬
為何在法院的判決中卻又說非屬契約互負債務 不得主張同時履行抗辯?
專利法不已經明定雇用人與受雇人之間的關係了嗎?
受雇人的發明、新型、設計 ----> 雇用人
雇用人的報酬 ----> 受雇人
還是說 判決中所指的是 要有明定的契約才算互負債務?
而儘管不能主張同時履行抗辯
但雇用人依法還是要給受雇人報酬 是這樣嗎?
