各位鄉民大家晚安~
原PO最近家裡有點土地糾紛,所以來板上求解~
土地及房屋現況大概說明如下:
(1) 多人共同持分老丙建土地420坪,現在60%持分已由A、B、C三人買下!
另有12%持分為附近鄰居D所有,其餘28%持分非常亂,牽扯1~200人!
(2) A、B、C三人本人(或直系親屬)在這塊土地上各有一棟透天厝(屋齡30年)
每戶約占地32坪,這三棟房子有繳房屋稅,但無建物登記(無權狀)
問題(1):
A、B、C、D合計持分已超過2/3,如4人均同意,可否無償設定3棟透天厝的地上權?
問題(2):
依土地法34-1規定,持分達2/3以上者,可對整塊土地做處分!
如果想把整塊地賣給外人,我知道必須先通知共有人,讓共有人行使行優先購買權!
但如果想把"整塊地"賣給共有人之一呢? 是否只需ABCD四人(持分超過2/3)同意即可?
簡單說,A、B、C、D四人想把整塊地全部賣給A,讓地籍資料可以簡單一點!
之後再來做後續的分配!
因為...最近遇到持有2%持分的人想跟我們獅子大開口! QQ
