各位法律人大家好,有些問題想要聽聽大家的看法跟意見
我們家是住新北傳統舊公寓5樓(一層兩戶共10戶)
在民國82年的時候,父母在口頭跟鄰居們詢問同意下,我們蓋了磚造的違建(自住用)
面積約是平面的2/3,外面有露天的露台跟簡易的門讓住戶可以自由進出
並從六樓加裝樓梯可供住戶自由上頂樓曬衣服或其他用途
平常我們也不會鎖門,所以除了我們自己加蓋的磚造屋,其他地方住戶皆可活動
一直到三年前,因為家裡房子20幾年從未裝修漏水需要將整個廚房廁所打掉,
樓下四樓的鄰居家裡有建築師,他就檢舉我們修改5樓室內隔間.六樓違建等
目的就是要勒索我們讓他賺錢畫室內圖(都有錄音存證)
後來在經過建管處跟違章拆除大隊來看過後都沒有問題
我們頂加的部分確定就是列管,只要不要再動他即可

這幾天開始,樓下鄰居開始找我們麻煩,誣賴我們家人
甚至威脅說如果我們去報警,他就要檢舉我們頂樓違建
就算我們頂樓加蓋是緩拆列管,只要他要求我們歸還土地使用權
他隨時要求我們就是得拆
我想請問的是:
1.加蓋物屬於我們個人財產,就算早期住戶都已經口頭同意
20幾年來我們只要公共事務(例如洗水塔.裝門鈴)等公共費用我們都是負擔兩戶
真的如惡鄰所說,他們的土地使用面積被我們占據
只要他們要求我們就一定要拆嗎?
2.我們(121號)跟隔壁(123號)屬於同一棟大樓,頂樓也是連在一起無任何圍牆分開
如果算土地持份,樓下鄰居有兩戶,他們持份應該是2/5還是2/10?
3.如果他們有持份,我們可否直接將他們的持份部分買下來並簽切結
讓他們這一戶再也沒有辦法針對頂樓的使用權或持份過問?
懇請各位提供一點意見,針對樓下的惡鄰找麻煩已經快要搞到家庭失和了
