麻煩各位專業得幫我分析到底會不會被告??
事情是這樣
下標→7-11超商取貨付款
→發現買錯商品,留言給賣家告知→
收到手機簡訊,賣家說如果不去取貨付款,要轉帳給他運費和滯貨費用
→去付款取貨後,給賣家負評
以下是他的回覆

回覆 : 此買家購買商品指定7-11取貨付款~己到店你都不去領取付款~我多次留言~你都不
回~最後我發出~逾期不去領貨付款讓我損知己付的運費就請退回運費跟損失$80

寄出的7.8天我多次留言跟傳簡詢你都不理會~不是付款就是大爺~光是你的留言我就可以

然後我還有收到兩封手機
告知買錯商品後
1.請於二天內把運費跟損失80元轉帳到郵局帳號XXXX,
逾期直接提告,以下是提告過程XXX*(貼了一個網址給我),11月18日
更新 結案7-11買加惡意不取貨付款,只告他一條路
給負評之後
2.太多字了,只貼大要
小姐現你二天內改回評價,不然法院見,你我的簡訊都有留備份,
你說我態度惡劣就會請你先準備好,到時法官問你哪個字惡劣時,你就舉證好
,免得我到時再多告你公然侮辱一條,我方都是依法先告知不取貨的後果,
另外請檢視奇摩會員資料是否正確,否則傳票找不到人。
我知道買錯商品不去拿,是我的錯,但是收到他這麼恐怖的簡訊後,我也去付款取貨了,
我真的覺得這次交易感覺很差,所以給他負評,真的會因此被告嗎?
我查了一下法條,好像不構成公然侮辱和毀壞商譽
但是我不是非常懂法律
希望各位幫我,他昨天又傳簡訊說
今天下午17點前沒看到改回評價,不然他要去警察局做筆錄報案,
請星期三後保持手機通暢並準備好嘉義做筆錄,另外若不接電話會直接發存證信函
賣家網址不知道貼出來會不會有法律責任,所以先不貼!
