車禍肇逃 - 法律

事件是這樣，我爸某日晚上開車，
綠燈直行時忽然有台機車闖紅燈，
然後就發生擦撞了。
對方摔倒在地，問題來了，我爸居然覺得對方違規，
又看一下窗外對方站起來了，就開車離開(可能覺得有點不爽對方)。
最後對方告我爸肇事逃逸與過失傷害(對方肩有骨折)。
基本上事故的責任歸屬應該都在對方，行事紀錄器在做筆錄時也很清楚，
但是肇事逃逸是公訴罪，我想應該是背定了，
現在我想請教的是：
1.過失傷害這條會成立嗎?
2.在與對方的和解過程，如果對方開高價索賠，或是不願和解(對方的父親還蠻生氣的)，
我們該怎麼處理較好?
3.我們車體的損害保險公司會理賠嗎(有保乙式險)
真是抱歉老人家沒有法律常識才惹出現在這個大麻煩，
也麻煩請有經驗的朋友能給小弟一些建議，謝謝
