辦公室偷拍事件 - 法律

請問一下，如果發現辦公室有人用手機偷拍，
但一直沒有抓到現行犯(不只一次，先別噓為何被偷拍的人沒立刻抓單純不敢)，
不過有人證(不只一位，人證表示只是懷疑，但覺得加害者不是這樣的人，所以沒想太多)
現在被害者想出面指證，人證也願意出來指證，那麼有機會將他訴誅法律嗎?
另外會再去看監視器是否有辦法拍到加害者有這樣的動作，這樣子有辦法逼他交出電腦
來檢查嗎?
不過因為對方是個行事小心的人，所以我想手機照片應該會刪除，
Dropbox應該也會整理，唯一有辦法的可能就家用電腦留檔的資料了~~~
