勞基法草案,是不是能合法周休一日了? - 法律

對於勞基法修法,我有個疑惑。
如果現在有個徵人條件如下:
每月例休4天,(雖然現行法規至少要隔週休二日),實際上週六休息日都需上工,月薪3萬2。
現在勞基法修法,就算是一例一休2.0版本
以時薪150元試算薪資如下:
每天工作8小時x20天x時薪150元=24000元
每周休息日都上工8小時,加班費
2(hr)x150x4/3 + 6(hr)150x5/3 =1900元
1900元x4周=7600元
於是該員工總工資如下
24000元+7600元=31600元 < 3萬2
原先徵人的薪資3萬2還是高於31600元。
這還未討論時薪150元已高於法律規定。
所以就算是新勞基法
該徵人條件,只要調整底薪或計算方式,
看起來仍可以維持原樣?
甚至調低也還有空間,
但更可以放心的叫員工每週六整天上班,
違法周休一日變合法周休一日了?
