去年8月因為老父年邁以高,單純想把透天過戶給小弟
調出了謄本才赫然發現被設定了"最高限額抵押權"
接著就自然跑去了銀行,詢問這該筆抵押權是怎麼回事
原來是前屋主跟地區農會有借貸,將該房屋設定"最高限額抵押權30萬"
之後跟老父交易了該棟房屋,但不知為何抵押權卻沒有塗銷
接著地區農會被銀行收併,該筆抵押權自然歸銀行
之後前屋主跟該銀行有債務往來,生前居然有200多萬的債務
前屋主兒子也死亡,前屋主妻子也年邁以高無力償還
接著當我們跟銀行提出希望塗銷該筆抵押權,銀行則說必須付30萬才能塗銷
之後到了去年12月,在民意代表服務處進行了三次的協商
銀行分行三次皆以總行無授權,所以不同意該筆抵押權的塗銷或是折衷15萬
但,當我們請銀行提出"當年該筆債權文件"或是"債權憑證"等類似文件時
銀行坦承他們已經找不到該筆文件或是其他資料
且也是當我們拿著房屋謄本,該銀行也才知道有這筆抵押權的存在
而我們也合理懷疑,其實當年前屋主早就清償完畢,只是沒有做塗銷
因年代久遠,相關的清償證明也無從找尋
現在已經經過了半年,變成銀行無法跟我們討該筆30萬,因為沒有債權憑證
而我們也無法塗銷該筆抵押權,銀行的說法是前屋主還有200多萬的債務
試問廣大的鄉民,真的只有走上打官司一途了嗎?
