請問公司有意思要調動員工部門,或短期支援其他部門,但該某勞工有身體上之不可抗拒
因素,是否可以提出證明拒絕調動,或是請求資遣,因為若該勞工去該部門可能會出現職
場霸凌,若是非得要等到職場霸凌真的出現,才能請求拒絕資遣,那已經對該勞工發生霸
凌傷害之事實。
該勞工有不可抗拒之遺傳疾病,但非法定傳染疾病,但該部門工作,必須全身脫光換上該
部門法定之工作服。雖然脫衣服不是啥大不了之事,但該員工之身體障礙的確對個人照成
困擾,或許對其他不瞭解之員工也是一種負擔。
