想請問各位前輩 11/6號原本要跟對方承租辦公室
對方從頭到尾隱瞞自己是仲介 且月租金偏高
想租的意願本來就不太高 後面想調降2000
仲介表示願意跟屋主溝通 已經先繳訂金5000
隨即又表示要押金75000 本人審酌押金過高且無保障
又礙於辦公室已經立即要用 於是以一半37500
又多匯了32500給仲介(含訂金5000在裡面一共37500)(無收據 有匯款證明)
且有跟仲介聲明 若合約內容看了不喜歡或不合意不想租了
對方要全額退款 對方也允諾.....
契約內容看了實在是很不ok 所以不租了
對方說 什麼我們這樣犯了什麼民法怎樣怎樣的
要把我們的押金訂金沒收 訂金我可以理解 5000就不追究了
但押金是怎麼一回事?哪一條法律有規定不租的話要被沒收押金@@?
1.所以想請問各位前輩 我這樣有觸犯民法哪一條嗎?
2.他若是執意不還 又犯了哪條呢 ?
因為想自己寫存證信函 要確保自己的權益是否受到保障
不想占人便宜 也不想別人來占我便宜
