錄取的新雇主要求試用期以定期契約代之 - 法律

最近面試一家長x美術館,得到錄取通知後
預約一星期後報到,但過四天後突然打電話來提議
董事長想避免若因我能力不足而必須走上資遣一路
公司也背負資遣勞工,名聲怕有損
所以希望我以簽定一個月的定期契約來替代
想詢問,這樣究竟有無確實違反勞基法?(非法官自由心證那種~)
若有違勞基法,但公司抗告,只是單純聘人作事一個月,
勞方如何自保?只有人力銀行上的書信往來,
就可證明原錄取時談好的是正職試用期嗎?
目前一切都還在談,我希望一切照原本談的不適用就資遣即可
但雇主卻不停說服我接受定期契約
並說這是坊間企業流行的方法,同時避免背上資遺員工惡名
又能試用新進員工究竟合不合用? =.="
資方出這個主意,就好像先預謀了要先搞掉我的樣子
讓我原本期待新工作上任的心情,變地很不愉快
所以,企業方有了資遣員工的紀錄,會被公開?
或是申請什麼補助之類會被拒嗎?
