關於不動產設定抵押權問題 - 法律

各位大大好,想請教一個問題,如影片所說,假設投資客A找出名人B做”借名登記”不動産(無血緣關系),有簽類似影片說的借名登記合約,由A負擔所有費用,B只出名及貸款
假設購買一間房子總價1000萬,投資客A付頭期款200萬,由B向銀行貸款800萬,而投資客A為了避免房子被偷賣,設定房屋抵押權(房貸銀行為第一順位,投資客B為第二順位)
此時若發生投資客A繳不出房貸,導致房屋被銀行法拍,而銀行將房子法拍以800萬賣出
請問大大,此時投資客A可否以房子的第二順位抵押權人,向出名人B求取200萬的頭期款賠嘗??
或者只有出名人B偷賣房子的時候,投資客A才可行使低押權向B索賠?
設定第二順位抵押權要如何可以保障到A的利益呢??
