關於附條件房屋買賣交易 - 法律

買方A先生賣方B小姐,於房屋買賣交易時,A先生同意B小姐繼續無償使用買賣標的直至
B小姐高齡95歲母親往生後再18個月,再行搬離,但A先生得知B小姐已購置新屋(目前出租),
且高齡95歲母親也已得知房屋已經售出,情緒並無太大起伏,故A先生請求B小姐搬出,
因為當初顧慮母親受影響的原因已不存在,但B小姐主張買賣合約附約清楚載明當初約定
條件是母親往生後她才必須搬離,故不願搬出,因此A先生遂提出告訴,控告B小姐返還房屋,
原因是當初附帶條件的好意,已不存在,要求B小姐搬離.
不知這樣的案件,就法律的觀點,對A先生與B小姐,各會有什麼樣的解釋呢?實務上法官
會如何判呢?
