大家好，
小弟在颱風天的時候，
因為不熟路況沒有注意橋樑路邊可停放車輛而撞上，
人翻出摩托車後被後方來車追撞腰部造成脊椎骨斷裂，
追撞我的對方(雙載)也翻車飛出，
並因為安全帽造成臉部撕裂傷，
後來警方初判表的結果只有我本身有肇因，
後方追撞完全無肇因，
所以對方一口咬定是我撞傷他向我索賠，
因為不服初判結果
我方這裡去申請交通事故鑑定，
但經過鑑定委員會需要時間，
所以我跟對方構通，
希望能夠等鑑定結果再談和解，
但對方不耐，
表示若我不跟他和解就要對我提出告訴
我的問題
1.這樣我是否構成過失傷害要件？
2.如果還是被起訴，是否有判例可以參考？
