關於這個問題則需視個案論斷.....
1.基本上若為一年一聘制,勞工雖滿工作年資一年以上者,依照勞基法規定勞工應享有特休假之權益...
2.然而,依照合約工作年資剛滿一年,卻因合約到期而使特休假之權益消失,因合約到期視同離職..
3.但是~~若是重新繼續續約,定期契約屆滿後,事業單位如在三個月內再與原勞工簽訂新契約者,則雇主必須承認該前後之工作年資。是以~~依法雇主需給勞工特休假.
