國營機構對試用期不合格者予以解僱之疑問 - 行政法

所謂的國營機構是指由經濟部,財政部等100%持股之機構
雖然在招考簡章上有註明:工作試用6個月,不合格者予以解僱
但該機構卻僅只口頭說過"考核目標"
卻未有針對"未達該目標對考核之影響比例"以及"考核之標準為何"
做任何口頭或書面說明
臨時在屆滿考核期間前半個月才通知考核標準
想請教板上先進
縱使簡章有不合格解僱之約定,但對於人民基本權(工作權)之重大影響
能夠不用"事先"以"書面"告知"未達該目標對考核之影響比例"與"考核之標準為何"嗎?
我個人覺得僅以口頭且未事先書面告知考核標準的前提下,即剝奪人民基本權
我覺得非常不能接受
因僱員與該機構之關係係行政契約
若最後打到行政法院,會有勝算嗎?
能夠主張的點會是什麼呢?
