最低薪資扣伙食費 - 法律

目前在一家餐飲業當建教實習生,
原本每個月都是領最低薪資17880再另外扣除勞健保費
月休4天,每天工作8小時以上
二月遇上過年期間額外加給2500
因為長期超工時才向學校反映此事,才計算之前每月的總工作時數
三個月來每個月工作時數為220~250小時
老闆認為我們太計較於是收回春節加給的2500
並以每個月工作天數26(月休4天)x8小時計算出「每月必須工作192小時」
實際工作時間-192=超工時,最後再乘以98計算出加班費
公司說如果要計算98元加班費,則要強制補扣之前的伙食費
於是用實際工作時數/8小時*50(每8小時供應兩餐)算出要補扣的金額
(姑且不論公式有問題,250/8根本超過31天)
假使該月沒有超工時,
則是領17880-530(勞健保)-1300=16050
想請問扣伙食費這點是否有法律可依據?
(當初簽合約是簽依勞基法規定)
