民法物權再一彈XD
題目:
甲向乙購買土地,並已给付價金100W元,但未過戶,經20年後,乙之土地由其獨子丙繼承
,期間甲均未曾請求過戶,問:
A.丙可否主張時效抗辯而拒絕過戶予甲?
B.如甲10多年來,在土地上已興建一間茶藝館,該茶藝館是否為無權占有?
C.丙可否主張退還100W元而請求甲拆屋還地?
D.如丙將土地再轉賣善意第三人丁,丁可否請求甲返還土地?請說明之。
想法:
A.
可。
請求移轉登記是基於債權,故有消滅時效之適用。
再者丙是基於繼承得到土地,並無不當得利。
B.
否,因為甲有付價金予乙。

否,應該要補償甲,但是不知道用哪一個條文。

不動產登記,具有絕對效力,以保護善意第三人,縱使其登記原因無效或撤銷,真正權利
人亦不得以之對抗善意第三人。本題甲為真正權利人,丁為善意第三人,故丁可請求甲返
還土地。
